Have You Forgotten About POPI?

Have You Forgotten About POPI?

Spencer Cason

For many, 2021 is a year to forget because of continued struggles caused by the pandemic, not to mention the civil unrest in KZN and parts of Gauteng.

However, there is something from 2021 which you are well-advised to remember. On 1 July, the entire Protection of Personal Information Act came into force and from that date, compliance with the Act became mandatory.

At the time there was significant activity as organisations were trying to become compliant at the last minute.

Perhaps you fall into this category, and you had a POPI policy hastily prepared. In this case, you should bear in mind that compliance with POPI requires more than a policy document – it is an ongoing exercise. Depending on your business, you may require several separate policies dealing with different issues, and practical guidance on the implementation of these.

If POPI has been on the backburner and you still need to deal with it, then there is no time like the present. A good starting point is a solid privacy policy which can serve as the roadmap towards compliance. Thereafter, depending on your business, further detailed policies and procedures can be prepared and implemented.

Either way, proper compliance will require careful attention from a designated person in the organisation.

The good news is that compliance is achievable, and, for many businesses, the initial steps can be quick and cost-effective.
